These Terms and Conditions ("Agreement") govern your use of the services, website, and products provided by Payten's Pic's. By booking, purchasing, or using our services, you agree to these terms.
1. Definitions
"Client" refers to any individual or entity booking or purchasing services from Payten's Pic's.
"Photographer" refers to Payten's Pic's, its owner(s), employees, or authorized representatives.
"Services" refers to all photography-related offerings, including but not limited to photo sessions, prints, and digital image delivery.
2. Booking and Payment Terms
A non-refundable deposit is required at the time of booking to secure your session date. The remaining balance is due on or before the day of the session, unless otherwise agreed in writing.
Payment methods accepted include Cash, Venmo, or PayPal
Late payments may incur additional fees or interest as specified in your invoice.
3. Cancellations and Rescheduling
Cancellations made by the client less than 48 hours before the scheduled session may result in forfeiture of the deposit.
If Payten's Pic's must cancel due to unforeseen circumstances, clients will be offered a full refund or the option to reschedule at no additional charge.
4. Intellectual Property and Usage Rights
All photographs and content remain the intellectual property of Payten's Pic's unless otherwise specified in a written agreement.
Clients receive a limited license for personal use of purchased images. Commercial use, reproduction, or distribution without written permission is prohibited.
Payten's Pic's reserves the right to use images for promotional purposes unless the client requests otherwise in writing.
5. Delivery of Images and Products
Digital images and/or prints will be delivered within 2-4 weeks after the session.
Delivery timelines may vary for custom products or during peak periods. Clients will be notified of any delays.
6. Limitation of Liability
Payten's Pic's will take reasonable care in providing services but is not liable for circumstances beyond its control, including equipment failure, weather conditions, or client non-cooperation.
Liability for any claim, loss, or injury is limited to the amount paid for the services in question.
7. Governing Law
These terms are governed by the laws of Illinois. Any disputes will be resolved in the courts of that jurisdiction.
8. Changes to Terms
Payten's Pic's reserves the right to update these Terms and Conditions at any time. Changes will be posted on our website and are effective immediately upon posting.
